These Terms and Conditions set out the basis on which Waste Disposal Dulwich provides waste disposal, rubbish removal and related collection services to residential and commercial customers. By booking a collection or otherwise engaging our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business or organisation who requests and pays for the waste disposal services.
Services means the waste disposal, rubbish removal, collection, loading, transportation, and related activities carried out by Waste Disposal Dulwich.
Waste means any items, materials or substances presented by the Customer for collection, removal or disposal, excluding any prohibited or hazardous items listed in these Terms and Conditions.
Agreement means the contract between Waste Disposal Dulwich and the Customer for the provision of Services, incorporating these Terms and Conditions and any written confirmation of the booking.
Waste Disposal Dulwich provides waste disposal and rubbish collection services within Dulwich and nearby areas, including but not limited to household waste clearance, garden waste removal, bulky item collection and non-hazardous commercial waste collection.
The exact scope of Services for each booking, including the type and approximate volume of waste, access arrangements, and location, will be agreed at the time of booking based on the information provided by the Customer.
Waste Disposal Dulwich reserves the right to refuse to collect any items that are not accurately described at the time of booking, that are unsafe to handle, or that are prohibited under relevant waste regulations.
3.1 Bookings can be made by telephone or other communication methods as made available by Waste Disposal Dulwich from time to time.
3.2 At the time of booking, the Customer must provide accurate and complete information, including but not limited to:
a. Full name and contact details.
b. Collection address and any access restrictions.
c. Description, type and approximate quantity or volume of waste.
d. Preferred collection date and time window.
3.3 Waste Disposal Dulwich will provide a price estimate or quote based on the information supplied. This quote may be revised on arrival if the actual volume or type of waste differs from that described by the Customer.
3.4 A booking is only confirmed when Waste Disposal Dulwich has accepted the Customer’s request and has provided confirmation of the booking details. Waste Disposal Dulwich reserves the right to decline any booking at its discretion.
4.1 The Customer must ensure that Waste Disposal Dulwich has safe, reasonable and unobstructed access to the collection address at the agreed date and time.
4.2 Any parking permits, access codes, keys or instructions required to reach the waste must be provided in advance or on arrival. The Customer is responsible for any parking charges or fines incurred as a direct result of incomplete or inaccurate access information supplied.
4.3 Waste Disposal Dulwich staff are not required to dismantle fixtures, remove doors or alter any part of the property structure to access the waste, unless expressly agreed in writing in advance.
4.4 The Customer must ensure that the waste is clearly identified and separated where necessary, and that it does not contain any prohibited or hazardous items as outlined in these Terms and Conditions.
5.1 Waste Disposal Dulwich operates in accordance with applicable UK waste management legislation and guidance, including the duty of care for waste handling and disposal.
5.2 The Customer is responsible for ensuring that all waste presented for collection is lawful to dispose of and is correctly described. Waste Disposal Dulwich may require the Customer to confirm the origin and composition of the waste.
5.3 The following items are not accepted unless expressly agreed in writing prior to the booking and may require specialist handling:
a. Hazardous waste, including but not limited to chemicals, solvents, paints, oils and asbestos.
b. Clinical or medical waste.
c. Pressurised containers, gas bottles or cylinders.
d. Explosives, ammunition or weapons.
e. Radioactive materials.
5.4 If, during the collection, Waste Disposal Dulwich discovers any prohibited or hazardous waste that was not declared at the time of booking, we may refuse to remove such items, charge additional fees for handling, or terminate the Service without refund.
5.5 Waste Disposal Dulwich will transport collected waste only to authorised facilities for reuse, recycling, recovery or disposal, in line with applicable waste regulations.
6.1 Prices are generally based on the type and volume of waste, the time required to complete the collection, and any special access considerations.
6.2 Any price estimate given prior to collection is based on the information supplied by the Customer. If the waste volume or nature is different from that described, Waste Disposal Dulwich reserves the right to adjust the price accordingly before commencing work.
6.3 Unless agreed otherwise in writing, payment is due in full upon completion of the Service at the collection address. Waste Disposal Dulwich may request partial or full payment in advance for certain bookings.
6.4 Payment may be made using the methods accepted by Waste Disposal Dulwich at the time of booking or collection. The Customer warrants that any payment method used is valid and that they are authorised to use it.
6.5 All prices are quoted exclusive of any applicable taxes or charges unless stated otherwise. The Customer is responsible for any additional taxes or charges that may apply.
7.1 The Customer may cancel or amend a booking by contacting Waste Disposal Dulwich as soon as possible.
7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded at the discretion of Waste Disposal Dulwich, less any reasonable administration fees.
7.3 If the Customer cancels within 24 hours of the scheduled collection time, fails to provide access, or is not present where required, Waste Disposal Dulwich reserves the right to charge a cancellation fee up to the full quoted price to cover costs and lost capacity.
7.4 Waste Disposal Dulwich will use reasonable efforts to accommodate requested changes to the date, time or scope of the Service, but cannot guarantee availability. Changes may result in an updated quote.
7.5 Waste Disposal Dulwich may cancel or reschedule a booking due to events beyond its reasonable control, including severe weather, vehicle breakdowns, staff illness or safety concerns. In such cases, the Customer will be offered an alternative time or a refund of any pre-paid amount relating to the cancelled Service.
8.1 The Customer is responsible for ensuring that the waste presented for collection is safe to handle and does not pose a risk to the health or safety of Waste Disposal Dulwich personnel, the public or the environment.
8.2 The Customer agrees to indemnify Waste Disposal Dulwich against any claims, losses, damages, costs or expenses arising out of:
a. The presence of hazardous, prohibited or misdescribed waste.
b. Breach of these Terms and Conditions by the Customer.
c. Any failure by the Customer to comply with applicable waste laws or regulations.
8.3 The Customer shall be responsible for securing and removing any personal items or valuables from waste items prior to collection. Waste Disposal Dulwich accepts no responsibility for items removed in error with waste.
9.1 Waste Disposal Dulwich will exercise reasonable care and skill in providing the Services.
9.2 Nothing in these Terms and Conditions shall limit or exclude Waste Disposal Dulwich liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
9.3 Subject to the above, Waste Disposal Dulwich will not be liable for:
a. Any indirect, consequential or economic loss, including loss of profit, revenue, business or opportunity.
b. Any loss arising from the Customer’s failure to comply with these Terms and Conditions, including failure to disclose the nature or volume of the waste.
c. Any damage to property resulting from inadequate access, structural weaknesses, or pre-existing defects at the premises.
9.4 If Waste Disposal Dulwich is found liable for damage to property directly caused by its negligence, its liability shall, to the fullest extent permitted by law, be limited to the reasonable cost of repair or replacement, taking into account the age and condition of the property.
9.5 In any event, and to the maximum extent permitted by law, Waste Disposal Dulwich total aggregate liability for all claims arising out of or in connection with a single booking shall be limited to the total amount paid by the Customer for that booking.
10.1 Waste Disposal Dulwich reserves the right to refuse or suspend the Service if:
a. The waste is not as described at the time of booking.
b. There are health and safety concerns for staff, the public or the environment.
c. Adequate access is not available or is unsafe.
d. The Customer behaves in an abusive, threatening or otherwise unreasonable manner.
10.2 Where Service is refused or suspended due to circumstances within the Customer’s control, the Customer may be charged a call-out or cancellation fee.
11.1 Waste Disposal Dulwich will collect and process personal data provided by the Customer for the purposes of administering bookings, providing Services, processing payments and complying with legal obligations.
11.2 Personal data will be handled in accordance with applicable data protection laws in the United Kingdom. Waste Disposal Dulwich may retain booking and transaction records for a reasonable period to comply with regulatory and tax requirements.
12.1 If the Customer is not satisfied with the Service, they should contact Waste Disposal Dulwich as soon as reasonably practicable, providing details of the issue and any relevant evidence.
12.2 Waste Disposal Dulwich will investigate complaints in good faith and seek to resolve them promptly. Depending on the circumstances, possible resolutions may include re-attendance, partial refund, or another appropriate remedy.
12.3 Raising a complaint does not entitle the Customer to withhold payment for Services already provided unless otherwise agreed in writing.
13.1 Waste Disposal Dulwich shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to extreme weather, natural disasters, strikes, accidents, transport disruption, or legal restrictions.
13.2 In such cases, Waste Disposal Dulwich will use reasonable endeavours to resume the Services as soon as it is safe and practicable to do so.
14.1 Waste Disposal Dulwich reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the date the revised Terms and Conditions come into effect.
14.2 The version of the Terms and Conditions in force at the time of booking will apply to that specific Agreement unless changes are required by law.
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By making a booking with Waste Disposal Dulwich, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
